One major Idaho specific factor that you need to be aware of when selling your home is Idaho’s disclosure laws for home sales. This essentially means that homeowners are required by law to specify certain defects within a home or property to the buyer within their knowledge. These disclosures have to be made before you sign any purchase contracts. According to nolo.com, “Idaho Statute 55-2501, et seq. mandates that you must make certain disclosures to potential buyers within ten days of the date of their offer to purchase your property. As the legislation itself states, the intent of the statute is ‘to promote the public health, safety and welfare and to protect consumers [by requiring] sellers of residential real property… to disclose certain defects in the residential real property to a prospective buyer.’”
There are a few things that such disclosures entail, including defects with any appliances that one might have on the property or are leaving behind (stove, refrigerator, water heater, garage door, etc.), pest infestations (rodents or insects), or hazardous materials. Also included as a part of this (that you will see when you are filling out the official disclosure form), is the catchall phrase, “Any other problems, including legal, physical or other not listed above that you know concerning the property.”
Selling a Home in Idaho – Disclosure Laws and Inspections
For sellers, one protection that such disclosure laws provide is that you only have to disclose what you as the seller know about, independent of what an inspector or an engineering report might find. The disclosure form specifically states, “the Seller does not possess any expertise in construction, architectural, engineering or any other specific areas related to the construction or condition of the improvements on the property. [Moreover] the Seller has not conducted any inspection of generally inaccessible areas such as the foundation or roof. It is not a warranty of any kind by the Seller or by any agent representing any Seller in this transaction. It is not a substitute for any inspections. Purchaser is encouraged to obtain his/her own professional inspections.” So, no, you don’t have to get on the roof, inspect your foundation, or do anything too out the ordinary in order to make sure your home is completely up to condition to sell. If you are like many of us, this comes as a welcome relief.
